App Terms and Conditions

These Terms and Conditions govern access to and use of the CoverApp mobile application and related app services.

1. Acceptance of the Terms

These Terms and Conditions (“Terms”) govern access to and use of the CoverApp mobile application, including its features, tools, content-creation capabilities, templates, visual resources, account functionality, Premium features, and other services made available through the application (collectively, the “Service”).

CoverApp is operated by CoverApp LLC (“CoverApp,” “we,” “us,” or “our”).

By accessing or using CoverApp, creating an account, or otherwise using any part of the Service, you acknowledge that you have read and understood these Terms and agree to be bound by them, together with any additional policies or terms that expressly apply to particular features or services.

If you do not agree to these Terms, you should not use the Service.

Certain features or services may also be subject to additional terms or policies, including the CoverApp Privacy Policy and, where applicable, the CoverApp Subscription Policy. Those documents govern their respective subject matter and apply in addition to these Terms where relevant.

2. Eligibility and Age Requirements

CoverApp is intended for adult users and is currently offered for use by individuals who are 18 years of age or older.

The Service is not currently designed or offered for use by individuals under 18 years of age.

CoverApp does not presently provide accounts or services specifically designed for minors or a parental-consent process for permitting minors to use the Service.

CoverApp may introduce age-appropriate functionality, age-assurance measures, parental-consent mechanisms, or related safeguards in the future where appropriate or required by applicable law.

Nothing in this section limits any age-related requirement or protection that applies under applicable law.

3. User Accounts and Access

Certain CoverApp features require, or may require, access through an authenticated user account.

Users are responsible for providing information reasonably necessary to establish and maintain their account and for taking reasonable measures to protect their account credentials, authentication methods, and devices used to access CoverApp.

Users must not knowingly permit unauthorized use of their account or use another person’s account, credentials, or identity without authorization.

CoverApp may use third-party authentication or identity services to facilitate account creation, authentication, account recovery, or related account functionality. The availability and operation of such services may also be subject to the applicable provider’s terms, policies, and technical requirements.

Access to particular CoverApp features may depend on factors including account status, authentication status, device capabilities, operating system, permissions granted by the user, internet or service availability, and, where applicable, an active CoverApp Premium entitlement.

Users are responsible for activities they knowingly perform, authorize, or permit through their account, subject to applicable law.

If a user becomes aware of or reasonably suspects unauthorized access to their account, credentials, or authentication methods, the user should take reasonable steps to secure the affected account and contact CoverApp support when appropriate.

CoverApp may implement reasonable authentication, verification, security, recovery, or account-protection measures when necessary to protect users, CoverApp, or the integrity of the Service.

4. Permission to Use CoverApp

Subject to these Terms and any applicable additional policies, CoverApp grants users a limited, personal, non-exclusive, non-transferable, non-sublicensable, and revocable permission to access and use the Service for its intended purposes.

This permission allows users to access and use functionality and resources made available through CoverApp, subject to the conditions, limitations, availability, and access requirements applicable to each feature.

Except where expressly authorized by CoverApp or permitted by applicable law, users may not copy, reproduce, distribute, sell, sublicense, commercially exploit, reverse engineer, circumvent access or security controls, interfere with, disrupt, modify without authorization, or attempt to obtain unauthorized access to CoverApp’s software, systems, protected functionality, or proprietary components.

CoverApp and its applicable licensors retain their respective rights in the software, technology, trademarks, interfaces, designs, templates, visual resources, effects, and other materials owned by or licensed to them and made available as part of the Service.

Nothing in these Terms transfers to a user any ownership interest in CoverApp’s software, technology, trademarks, or other proprietary materials merely by reason of the user’s access to or use of the Service.

User Content is addressed separately in these Terms. Use of CoverApp to create, import, edit, process, save, export, share, or publish User Content does not, by itself, transfer ownership of that User Content to CoverApp.

All rights not expressly granted under these Terms are reserved by CoverApp and, where applicable, the respective rights holders.

5. Application Features and Services

CoverApp provides tools designed to assist users in creating, capturing, editing, organizing, composing, previewing, saving, exporting, and sharing visual and audiovisual content through supported application features.

Depending on the application version, device, platform, account status, permissions, and feature availability, CoverApp may provide functionality involving photography, video, Dual Camera experiences, templates, visual effects, 360-related templates or experiences, Action/Reaction functionality, project composition, text and visual elements, voice or audio functionality, media export, and other creative tools.

Certain features may require access to device capabilities or user-authorized resources, including the camera, microphone, photos, videos, media library, network connectivity, or other supported system functionality. A feature may be unavailable or operate differently when required permissions, services, connectivity, or compatible device capabilities are unavailable.

CoverApp may offer generally available functionality as well as functionality requiring an active CoverApp Premium entitlement. The specific benefits included with CoverApp Premium are determined by the applicable offering and are further governed by the CoverApp Subscription Policy and the purchase terms presented through the applicable distribution platform.

A CoverApp Premium subscription provides access to the Premium benefits included with the applicable offering during the period in which the corresponding entitlement remains active. Premium access does not transfer ownership of CoverApp technology, software, or other proprietary resources to the subscriber.

6. User Content

“User Content” means photos, videos, audio, text, logos, images, designs, or other materials that a user creates, captures, imports, uploads, adds, edits, processes, saves, exports, shares, or otherwise uses through CoverApp.

Users retain any rights they hold in their User Content. Using CoverApp does not, by itself, transfer ownership of User Content to CoverApp.

Users are responsible for the User Content they choose to use through the Service and for ensuring that their use of such content complies with these Terms and applicable law.

CoverApp may process User Content as reasonably necessary to provide functionality requested or used by the user, including creating, capturing, importing, editing, composing, previewing, saving, exporting, sharing, synchronizing, or otherwise operating supported features of the Service.

Depending on the feature being used and the user’s account or authentication status, User Content may be processed or stored locally on the user’s device or may be transmitted to, synchronized with, stored by, or otherwise processed through CoverApp systems or service providers where necessary to provide supported account, project, synchronization, storage, or related functionality.

The handling of User Content and associated personal information is further described in the CoverApp Privacy Policy.

7. Rights and Permissions for User Content

Users must have the rights, permissions, licenses, consents, or other lawful authority reasonably necessary to use any content or materials they submit, import, incorporate, edit, process, export, share, or publish through CoverApp.

This responsibility may include, where applicable, rights relating to copyrights, trademarks, photographs, videos, music or audio, logos, designs, personal likenesses, privacy, publicity, and other intellectual-property or personal rights.

Users must not use CoverApp to create, distribute, publish, or otherwise make use of content in a manner that unlawfully infringes, misappropriates, or violates the rights of another person or entity.

CoverApp’s ability to technically process, edit, export, or otherwise handle particular content does not constitute a representation that the user has the legal right to use that content.

8. Prohibited Use

Users may not use CoverApp or the Service to engage in unlawful, fraudulent, deceptive, abusive, harassing, defamatory, or privacy-violating conduct.

Users also may not use the Service to:

  • impersonate another person or entity, or materially misrepresent their identity or affiliation;
  • use, distribute, or publish materials without the authorization required by applicable law or the relevant rights holder;
  • infringe or misappropriate copyrights, trademarks, privacy rights, publicity rights, or other rights of third parties;
  • attempt to gain unauthorized access to accounts, systems, services, protected features, or data;
  • bypass, disable, interfere with, or circumvent security, access, entitlement, or technical restrictions of the Service;
  • introduce malicious code or intentionally interfere with the normal operation, integrity, or security of CoverApp or related systems; or
  • use the Service in a manner that violates applicable law or facilitates unlawful activity.

CoverApp reserves the right to take reasonable measures to protect the Service, its users, and its systems in response to suspected misuse, security threats, unlawful activity, or violations of these Terms, consistent with applicable law and the technical capabilities of the Service.

9. Intellectual Property and CoverApp Resources

The Service contains software, technology, interfaces, branding, designs, templates, effects, visual elements, and other resources that may be owned by CoverApp or made available to CoverApp under applicable licenses or other rights.

Except for the limited permission to use the Service granted under these Terms, no provision of these Terms grants users ownership of CoverApp’s intellectual property or of third-party materials made available through the Service.

Users may use templates, effects, visual resources, and other functionality made available through CoverApp as part of creating content through the Service, subject to these Terms, any limitations communicated within the applicable feature, and any rights or restrictions that may apply to particular materials.

The incorporation of CoverApp-provided resources into User Content does not transfer ownership of the underlying CoverApp software, technology, templates, effects, designs, or other protected resources to the user.

Nothing in these Terms is intended to claim ownership by CoverApp over User Content merely because it was created, edited, processed, saved, exported, or otherwise handled using CoverApp.

10. CoverApp Premium and Subscriptions

CoverApp may offer paid subscription plans that provide access to designated Premium features and benefits (“CoverApp Premium”).

The specific features, benefits, subscription periods, prices, and other purchase information applicable to a CoverApp Premium offering are those presented to the user through CoverApp and the applicable distribution or payment platform at the time of purchase.

Access to Premium functionality depends on the applicable subscription or entitlement remaining active and being recognized by the Service.

Subscriptions, including applicable renewal, cancellation, restoration of purchases, refunds, and feature availability, are further governed by the CoverApp Subscription Policy and by any applicable terms of the platform through which the subscription was purchased.

Purchasing CoverApp Premium grants access to the applicable Premium functionality during the corresponding entitlement period. It does not transfer ownership of CoverApp software, technology, templates, effects, designs, or other proprietary resources.

Unless expressly stated otherwise for a particular offering, CoverApp Premium does not constitute an advertising-free version of CoverApp.

11. Advertising and Promotional Content

CoverApp may display advertising, promotional, sponsored, or other commercial content within areas of the Service designated for that purpose.

Such content may include images or videos and, where enabled, interactive functionality or links to external destinations.

Advertising or promotional content displayed through CoverApp may be supplied, scheduled, changed, or made available through promotional systems associated with the Service. Individual campaigns, their availability, and their content may change over time.

Advertising availability is independent from CoverApp Premium access. Unless CoverApp expressly states otherwise for a particular product, plan, or promotional offer, a CoverApp Premium subscription does not remove advertising or constitute an advertising-free version of the Service.

When no advertising or promotional campaign is available for a designated placement, CoverApp may display its own branding, informational material, fallback content, or other appropriate content within that area.

Where advertising or promotional content provides access to an external destination, the user’s interaction with that destination may be governed by the terms, privacy practices, and policies of the applicable third party.

The display of third-party advertising or promotional content through CoverApp does not, by itself, constitute an endorsement, warranty, or guarantee by CoverApp regarding the advertiser or any third-party product, service, representation, offer, content, or destination.

12. Third-Party Services and Platforms

Certain CoverApp functionality may depend on or interact with services, technologies, operating systems, application stores, authentication providers, payment or subscription platforms, or external destinations operated by third parties.

The availability and operation of those third-party services may be subject to their own terms, privacy policies, technical requirements, account requirements, availability, and decisions.

When a user voluntarily leaves CoverApp or interacts with an external destination, service, or platform, that interaction may be governed by the applicable third party’s terms and privacy practices.

CoverApp does not control the independent operation, availability, policies, or content of third-party services merely because CoverApp interoperates with, authenticates through, links to, or relies on those services for particular functionality.

Nothing in this section limits any responsibility that CoverApp may have under applicable law for its own processing, conduct, representations, or obligations.

13. Availability, Changes, and Updates

CoverApp may maintain, update, improve, modify, add, replace, or discontinue features and functionality as the Service evolves.

The availability or operation of particular functionality may depend on factors including application version, device capabilities, operating system, user-authorized permissions, authentication or account status, internet connectivity, supported third-party services, and, where applicable, an active Premium entitlement.

Updates may include technical fixes, security improvements, compatibility changes, interface or visual improvements, new functionality, modifications to existing functionality, or other changes intended to maintain or develop the Service.

CoverApp does not guarantee that every feature will remain available indefinitely or operate identically across every device, operating system, application version, or third-party environment.

Any modification, limitation, suspension, or discontinuation of functionality remains subject to applicable law and to obligations associated with products, services, or benefits already purchased by users.

14. Account Deletion

Users may request or initiate deletion of their CoverApp account through the account-deletion functionality made available by CoverApp.

Account deletion may require authentication, reauthentication, identity verification, or other reasonable security measures before the request can be completed.

When an account-deletion request is successfully completed, CoverApp will process deletion of the account and associated data in accordance with the CoverApp Privacy Policy, applicable retention requirements, and the technical processes used by the Service.

Deleting a CoverApp account does not automatically cancel an active subscription or its renewal when the subscription is managed through Apple, Google, or another applicable distribution platform. Users are responsible for managing or cancelling the subscription through the applicable platform when required. CoverApp may provide access to the applicable subscription-management destination before account deletion.

Certain information may be retained after account deletion where reasonably necessary or legally permitted for purposes described in the CoverApp Privacy Policy, including applicable legal, security, fraud-prevention, accounting, transactional, dispute-resolution, or compliance requirements.

Deletion of the CoverApp account may result in loss of access to projects, account-associated content, settings, entitlements, or other information connected to that account where such information is deleted or can no longer be associated with an active CoverApp account.

Account deletion or cessation of use does not affect provisions of these Terms that by their nature are intended to remain applicable afterward, to the extent permitted by applicable law.

15. Disclaimers

To the maximum extent permitted by applicable law, CoverApp and the Service are provided on an “as available” basis.

CoverApp works to maintain and improve the Service but does not guarantee that every feature will always be available, uninterrupted, error-free, compatible with every device or operating-system configuration, or unaffected by circumstances outside CoverApp’s reasonable control.

The operation of certain features may depend on factors including device capabilities, operating-system functionality, permissions granted by the user, internet connectivity, authentication services, application stores, subscription platforms, and other third-party services or technologies.

Users are responsible for reviewing content they create, edit, process, export, share, or publish through CoverApp and for determining whether that content is appropriate for their intended use.

CoverApp does not guarantee that templates, effects, automated processes, previews, exports, or other creative functionality will produce a particular artistic, commercial, technical, or other result.

Nothing in these Terms excludes, restricts, or modifies any warranty, guarantee, right, remedy, or other protection that cannot lawfully be excluded, restricted, or modified under applicable law.

16. Limitation of Liability

To the maximum extent permitted by applicable law, CoverApp LLC and its applicable officers, directors, employees, contractors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising out of or relating to the user’s access to or use of, or inability to access or use, the Service.

This may include, to the extent permitted by applicable law, losses resulting from interruption or unavailability of the Service, loss of access to content or projects, loss of data, device or platform incompatibility, third-party services, or actions taken by users based on content created or processed through CoverApp.

CoverApp is not responsible for the independent acts, omissions, availability, content, products, services, or policies of third parties merely because CoverApp interoperates with, relies upon, authenticates through, or links to a third-party service.

The limitations in this section apply only to the extent permitted by applicable law and do not exclude or limit liability that cannot legally be excluded or limited.

Nothing in these Terms limits any rights or remedies available to users under applicable consumer-protection or other mandatory law.

17. Indemnification

To the extent permitted by applicable law, users agree to indemnify and hold harmless CoverApp LLC and its officers, directors, employees, and agents from third-party claims, liabilities, damages, losses, and reasonable costs arising directly from:

  • User Content that the user submits, imports, incorporates, edits, publishes, shares, or otherwise uses through the Service in violation of applicable law or the rights of another person or entity;
  • the user’s material violation of these Terms; or
  • the user’s unlawful or intentionally abusive use of the Service.

This obligation applies only to the extent that the applicable claim, liability, damage, loss, or cost results from the user’s own conduct or User Content for which the user is responsible.

This section does not require a user to indemnify CoverApp for CoverApp’s own negligence, willful misconduct, unlawful conduct, or any responsibility that cannot lawfully be excluded or transferred.

Nothing in this section limits rights or protections that cannot be waived under applicable law.

18. Governing Law and Disputes

These Terms and any dispute arising out of or relating to the use of CoverApp will be governed by the laws applicable to CoverApp LLC, without depriving users of any mandatory consumer protections that apply to them under applicable law.

Before initiating formal legal proceedings, users and CoverApp are encouraged, where appropriate, to make a reasonable good-faith effort to resolve the dispute informally. Users may contact CoverApp at support@coverapp.info regarding a dispute or concern.

If a dispute cannot be resolved informally, it may be brought before a court or other competent authority having jurisdiction under applicable law.

Nothing in these Terms prevents a user from exercising rights or remedies that cannot lawfully be waived, restricted, or excluded.

19. Changes to These Terms

CoverApp may update these Terms from time to time to reflect changes to the Service, applicable requirements, business practices, or other relevant circumstances.

When these Terms are updated, CoverApp will make the revised version available through an appropriate location associated with the Service and will update the applicable effective date or version information.

Where required by applicable law, CoverApp will provide additional notice or obtain consent before materially revised Terms become effective.

Continued use of the Service after updated Terms become effective may constitute acceptance of the revised Terms where permitted by applicable law.

Changes to these Terms do not retroactively eliminate rights or obligations that cannot lawfully be modified or waived.
